These Terms of Use (“Terms”) govern your access to and use of the Whizzler mobile application and the whizzler.app website (together, “Whizzler,” “the app,” or “the service”). Whizzler is operated by Shiba Studios LLC, a limited liability company registered in the State of New York, USA (“Shiba Studios,” “we,” “us,” or “our”). By creating an account or using Whizzler, you agree to these Terms. If you do not agree, do not use the service.
You must be at least 13 years old to use Whizzler. By using the service you represent that you meet this requirement and that the information you provide is accurate. If you are using Whizzler on behalf of a minor for whom you are responsible, you accept these Terms on their behalf.
Whizzler accounts are created using Sign in with Apple. You are responsible for the activity that occurs under your account and for keeping your device and Apple ID secure. You may choose a public display name; you may not impersonate others, use offensive or infringing names, or select a name intended to mislead other players.
When using Whizzler, you agree that you will not:
We may suspend or terminate accounts that violate these Terms or that harm the integrity of the game or other players.
Whizzler may offer virtual items, cosmetics, or currency, some of which may be available through in-app purchases processed by Apple. Virtual items have no real-world monetary value, are licensed to you (not sold) for use within the app, and are non-transferable and non-refundable except as required by law or by Apple's applicable policies. All purchases are handled by Apple and subject to Apple's terms; contact Apple for billing and refund requests.
Whizzler, including its software, design, question content, and the Whizzler name and logo, is owned by Shiba Studios LLC and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for your own personal, non-commercial entertainment. All rights not expressly granted are reserved.
Any content you provide, such as a display name, must not infringe the rights of others or violate these Terms. You grant us the right to display your public handle, avatar, and rating to other players as an inherent part of multiplayer gameplay.
Whizzler is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Shiba Studios LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of Whizzler. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim or ten U.S. dollars.
You may stop using Whizzler and delete your account at any time in the app (Settings → Delete account). We may suspend or terminate your access if you violate these Terms or if we discontinue the service. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of Whizzler will be subject to the exclusive jurisdiction of the state and federal courts located in New York.
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of Whizzler after an update constitutes acceptance of the revised Terms.
